Have a Question? Ask Us!

Residency Obligation appeals
Family Sponsorship appeals
Spousal Sponsorship appeals
What decisions can be appealed to the Federal Court of Canada?
Applications which can be judicially reviewed at the Federal Court include:
Refusals of Humanitarian and Compassionate applications
Refusals of Pre-Removal Risk Assessments
Refusals of Federal Skilled Worker applications
Refusals of Study Permits

In addition, if you have been ordered to leave Canada and have received a Direction to Report stating your departure date, you may seek to have the Federal Court intervene and temporarily suspend your deportation. You may do this by filing a Motion for a Stay of Removal. You will need to prove that there are strong reasons why you deserve to remain in Canada temporarily – for example, that you should be allowed to stay until an appeal you have filed has been heard.
